Terms of Service — Clearline

Agreement

These terms are between you and [CONFIRM] (ABN [CONFIRM]), trading as Clearline. By creating an account you agree to them.

The service

Clearline is a subscription CRM for real estate professionals. We provide it on an as-is basis and may change, add or remove features. We will not remove a significant feature without notice.

Your account

One account is for one agent. Keep your password secure and tell us promptly if you believe it has been compromised. You are responsible for activity under your account. You must be at least 18 and hold any licence your state requires for the work you do.

Trial and fees

New accounts receive a two-day free trial with no card required. After that, access requires an active subscription at $19.99 AUD per month per agent, billed monthly in advance through Stripe. Prices may change with 30 days' notice. GST treatment is confirmed at checkout [CONFIRM].

Cancellation and refunds

Cancel at any time from the billing portal. Access continues until the end of the period you have paid for. We do not provide pro-rata refunds for partial months. Nothing here limits your rights under the Australian Consumer Law.

Your data

You own the data you put into Clearline. You grant us only the licence needed to store and process it to provide the service. You warrant that you have the right to upload the contact information you enter and that doing so does not breach the Privacy Act, the Spam Act or the Do Not Call Register Act.

Acceptable use

Do not use Clearline to send unsolicited marketing in breach of the Spam Act, to call numbers on the Do Not Call Register where that would be unlawful, to upload data you have no right to hold, to attempt to access another account, or to resell the service.

Availability

We aim for continuous availability but do not guarantee it. The service may be unavailable for maintenance or because of a third-party provider outage.

Liability

To the extent permitted by law, our total liability in any 12-month period is limited to the fees you paid in that period. We are not liable for indirect or consequential loss, including lost listings, lost commission or lost data. Nothing excludes any guarantee that cannot lawfully be excluded under the Australian Consumer Law.

Termination

You may cancel at any time. We may suspend or terminate an account that breaches these terms, and will give notice and a chance to fix it where it is reasonable to do so. On termination, your data is retained 30 days then deleted.

Governing law

These terms are governed by the laws of Queensland, Australia [CONFIRM], and you submit to the non-exclusive jurisdiction of its courts.
